4. Payment and Fees

a. Payment Terms

  • Full or partial payment is required to begin any project, depending on the agreed terms.
  • Invoices must be paid within the specified timeframe mentioned on the invoice.

b. Late Payments

  • Late payments may incur additional charges or suspension of services.

c. Refund Policy

  • Refunds are provided only under the following circumstances:
    • The project has not commenced.
    • There is a mutual agreement for termination.
  • No refunds will be issued once work has begun unless otherwise agreed.

5. Intellectual Property

a. Ownership

  • Upon full payment, the intellectual property rights of the completed project will be transferred to the client.
  • SoftaWeb retains the right to use completed projects for portfolio purposes unless otherwise agreed.

b. Restrictions

You may not:

  • Resell or distribute our work without permission.
  • Modify our designs or code without explicit consent.

6. Limitation of Liability

SoftaWeb is not liable for:

  • Loss of data, revenue, or profits due to service interruptions.
  • Delays caused by third-party vendors or clients.
  • Issues arising from improper usage or modifications to our services.

7. Client Responsibilities

  • You are responsible for providing accurate information, content, and feedback for your project.
  • Any delays caused by lack of communication or incomplete information will not be the responsibility of SoftaWeb.

8. Termination

a. Termination by the Client

You may terminate the agreement by providing written notice. Refund eligibility will be subject to the refund policy stated above.

b. Termination by SoftaWeb

We reserve the right to terminate services in case of:

  • Non-payment.
  • Violation of these terms.
  • Behavior deemed abusive or unprofessional.

9. Privacy Policy

Your use of our services is also governed by our Privacy Policy. Please review it to understand how we handle your personal information.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Bangladesh.
